These Terms and Conditions govern your use of the GHAYA Jewelry website and your purchase of products from GHAYA. By accessing this website, creating an order or purchasing from us, you agree to these Terms and Conditions.
1. About GHAYA
GHAYA Jewelry operates from the State of Kuwait and offers jewelry, customized pieces and related services through this website and other approved sales channels.
2. Eligibility to Purchase
You must have the legal capacity to enter into a purchase agreement. If you are under the age of legal majority applicable to you, your order must be placed with the involvement and consent of a parent or legal guardian.
You are responsible for providing complete, current and accurate personal, delivery and payment information.
3. Products and Images
We make reasonable efforts to present our jewelry, colors, dimensions, materials and details accurately. However, the appearance of a product may vary slightly depending on photography, lighting and the settings of your device.
Because many GHAYA pieces are handmade or made using natural materials, gemstones and precious metals, minor variations in color, texture, weight and finish may occur. These natural or handcrafted variations are not normally considered defects.
4. Gold Weight and Product Information
Product weights and measurements displayed on the website may be approximate unless expressly stated otherwise. Small variations may occur during production, finishing or customization.
The final product supplied will comply with applicable hallmarking, precious-metals and commercial requirements in the State of Kuwait.
5. Prices
Product prices are shown in Kuwaiti Dinars unless another currency is clearly stated. Prices may change without prior notice due to changes in gold prices, gemstone costs, production costs or other commercial factors.
A price change will not affect an order that GHAYA has already accepted and confirmed, except where there is an obvious pricing or technical error.
Delivery fees, customs duties, taxes and other applicable charges may be added during checkout or charged by the destination country.
6. Orders and Acceptance
Submitting an order does not automatically mean that GHAYA has accepted it. After receiving your order, we may verify product availability, payment, delivery details and any required customer information.
GHAYA may refuse or cancel an order when reasonably necessary, including when:
- The product is unavailable.
- The price or product information contains an obvious error.
- Payment is not authorized or completed.
- Required identity verification is not provided.
- The order appears fraudulent, unlawful or unusually high-risk.
- Delivery cannot be provided to the selected destination.
If we cancel an order after receiving cleared payment, any refundable amount will be returned using the original payment method, subject to the payment provider’s processing time.
7. Identity Verification for Gold Purchases
Customers purchasing gold jewelry may be required to provide a clear and valid copy of their Kuwait Civil ID or passport. This requirement supports identity verification, record keeping and compliance with applicable regulatory and anti-money laundering obligations in the State of Kuwait.
GHAYA may place an order on hold or cancel it if the required identification document or related information is not provided or cannot be verified.

8. Payment
Orders must be paid using a payment method accepted by GHAYA. You confirm that you are authorized to use the selected payment method and that the information provided is accurate.
GHAYA is not responsible for delays or refusals caused by a bank, card issuer, payment provider or fraud-prevention review.
9. Customized, Engraved and Made-to-Order Pieces
You are responsible for checking all names, words, initials, dates, symbols, selections and design details before approving a customized order.
Production may begin after payment and approval. Once production has started, customized, engraved and made-to-order pieces ordinarily cannot be changed, cancelled, returned or exchanged unless they arrive defective, damaged or different from the approved order.
10. GHAYA Builder and Saved Designs
Builder previews and saved designs are visual representations intended to help customers arrange and select pieces. Screen previews may not reproduce the exact physical size, spacing, color or appearance of the finished jewelry.
Products included in a saved design remain subject to availability and current pricing until an order is accepted.
11. Preparation and Delivery
Ready-made pieces are normally prepared within 2–3 business days. Made-to-order pieces are normally prepared within 10–14 business days, unless a different timeframe is stated.
Preparation and delivery times are estimates and may be affected by weekends, public holidays, customization, customs procedures, courier delays or circumstances outside GHAYA’s reasonable control.

12. Returns and Exchanges
Approved returns and exchanges are governed by our Returns and Exchanges Policy. Certain pieces—including customized, engraved, made-to-order, worn, altered and final-sale pieces—may not be eligible for return or exchange, except where mandatory legal rights apply.

13. Care, Repairs and Alterations
Jewelry requires appropriate care. Damage caused by misuse, impact, chemicals, improper storage, normal wear or repair and alteration by another party may not be considered a manufacturing defect.
Repair services are assessed individually and may be subject to availability, inspection and additional charges.
14. Website Use
You must not misuse this website, interfere with its operation, attempt unauthorized access, introduce malicious software, copy protected materials unlawfully or use the website for fraudulent or illegal activity.
15. Intellectual Property
The GHAYA name, logos, jewelry designs, Ghaya Language, photographs, illustrations, website content, design-builder elements and other brand materials are owned by or licensed to GHAYA and are protected by applicable intellectual-property laws.
No GHAYA material may be copied, reproduced, modified, manufactured, distributed or commercially used without prior written permission.
16. Third-Party Services
The website may use or link to third-party payment, delivery, social media or other services. GHAYA is not responsible for the independent content, security, availability or privacy practices of those parties.
17. Limitation of Liability
To the extent permitted by applicable law, GHAYA will not be liable for indirect or consequential loss arising from website use, delivery delays outside our reasonable control or misuse of a product.
Nothing in these Terms excludes or limits liability or customer rights that cannot legally be excluded or limited under applicable law.
18. Events Outside Our Control
GHAYA will not be responsible for delay or failure caused by events outside its reasonable control, including courier disruption, customs delay, severe weather, government action, system interruption, supply shortage or force-majeure events.
19. Changes to These Terms
GHAYA may update these Terms and Conditions when its services, legal obligations or business practices change. The version published on this page at the time of an accepted order will normally apply to that order.
20. Governing Law
These Terms and Conditions are governed by the laws of the State of Kuwait. Any dispute will be subject to the jurisdiction of the competent courts of Kuwait, without limiting any mandatory rights available to a customer under applicable consumer-protection law.
